Korea’s Constitutional Court throws out impeachment of Prime Minister Han

South Korea’s Constitutional Court has dismissed the impeachment of Prime Minister Han Duck-soo, in the process reinstating him as acting president amid ongoing political turmoil following President Yoon Suk Yeol’s brief imposition of martial law.

According to the nation’s Yonhap News Agency, the court ruled by a five-to-one majority to dismiss the impeachment, with two justices voting to reject the motion outright.

The decision was reached almost three months after the National Assembly impeached Han, who was serving as acting president at the time. The opposition Democratic Party of Korea called for him to be impeached over his alleged involvement in Yoon’s controversial declaration of martial law on December 3.

It is reported that all but two justices agreed with the National Assembly’s interpretation that the quorum required to impeach Han was 151 out of 300 lawmakers, the threshold for a prime minister, rather than 200, which applies to a sitting president.

After the ruling, Yonhap reported that Han returned to his office where he said “I thank the Constitutional Court for its wise decision," adding "I will start by dealing with urgent issues first."
